    Article 2 – Access

     

     Access to the Website is reserved to people over the age of 18.

    Access to and use of the Website are for strictly personal use.

    You agree not to use the Website or the information or data contained for commercial, political and advertising purposes and other commercial solicitation and in particular the sending of unsolicited e-mails.

    Article 3 – Website content

     

     All trademarks, pictures, texts, comments, illustrations, animated pictures or not, video sequences, sounds, all software applications that might be used to operate the website and more generally all the elements reproduced or used on the Website are protected by intellectual property laws.

    They are the full and exclusive property of the Publishing Company or its partners. Any reproduction, representation, use or modification by any means, in full or in part, including software applications, without the prior written consent of the Publishing Company, are strictly forbidden.

    If the User does not respect these terms of use and if the Publishing Company does not immediately react, this does not mean that the Publishing Company waives its rights to act subsequently.

    Article 4 – Website management

     

     In order to ensure the good management of the Website, the Publishing Company can at any time:

    • To suspend, interrupt or to limit access to all or part of the Website, to a specific type of users;
    • To delete any information that could disturb the functioning of the Website or that is breaking the national and international laws, or the rules of the Netiquette;
    • To suspend the website in order to perform updates. 

    Article 5 – Responsibility

     

     The Publishing Company‘s liability may not be invoked in case of failure, suspensions or interruption preventing access to the Website or its functionalities.

     The connection equipment that is used is under the responsibility of the User.

    The User must also take all necessary measures to protect its equipment and its own data, more particularly from virus attacks. In addition, the User visits the other sites at his/her own risks and under his/her responsibility.

    The Publishing Company could not be liable in case of legal proceedings against the User:

    • Due to the use of the Website or other service accessible via Internet;
    • Due to the non-compliance with the present conditions.

    The Publishing Company is not liable for the damages caused to the user, to third parties or to the equipment by the connection or the utilization of the Website made by the User. The User waives its rights to act against the Publishing Company.

    In the event that the Publishing Company would be involved in a amical settlement or litigation because of the utilization of the Website made by the User, the company can file an action in order to obtain compensation of the damages, sums, sentences and costs due to the proceeding.

     Article 6 – Collect of data

     

     Personal data that may be collected on this Website are used by the Publishing Company for the management of the user relationship. They are saved in the Publishing Company database; such database is elaborated with personal data and thus declared to the National Commission on Computer Technology and Freedom (CNIL).

    According to the Data Protection Act of January 6th, 1978 amended, Users benefit from the right to access, amend, correct and delete personal information that has been collected about them.     The information collected can be communicated to third parties linked to the Publishing Company under contract for the execution of the subcontracted tasks necessary for the management of the User account and without his/her prior authorization. In case of an infringement of the relevant legal and regulatory provisions, this information may be communicated on specific and justified request of the judicial authorities.

    When certain information are necessary in order to access specific functionalities of the Website, the Publishing Company will indicate the obligatory nature at the time of the data entry.

    Article 7 – Cookies

     

     The Website can automatically collect standard information such as cookies. Cookies are small files that websites place on the device the User is using to browse the site. Cookies are commonly used to record some aspect of the User’s visit to a site such as choices the User has made or preferences the User has set during his/her visit and that can be read during the User’s visits on this same website.

     All the information collected indirectly will be used only for the purpose to track the volume, the type and the traffic configuration using the Website, in order to develop the conception, the design, other administrative purposes and planning and more generally to improve the service we offer to the users.

    To benefit from all the Website functionalities, it is preferable to parameterize the browser to accept cookies. We would like to stress that the cookies do not permit to identify the User and the period for the conservation of the information recorded by the cookies on the User’s computer is 13 months.

     The pictures of the products contained on the Website are given strictly for informative purposes and does not entail any legal commitment or implicit or explicit contractual agreement on the part of the Publishing Company which also reserves the right to modify its characteristics at any time.

    Article 9 – Jurisdiction and applicable law

     

    The Website and its content are governed by French law subject to provisions that cannot be derogated from by agreement by virtue of the law applicable to the User. All disputes in relation to the Site shall be subject to French courts.
